Usage Rights for User Generated Content (UGC)

We, Zwillingsherz GmbH, Modering 3, 22457 Hamburg, hereinafter referred to as "Zwillingsherz", "we" or "us", are delighted to receive inspiring outfit photos from our community.

Do you have a public Instagram account where you regularly post your outfits featuring Zwillingsherz products? Then you have the opportunity to become part of our community inspiration and inspire other customers with your looks.

Here's how it works:

1. Take a photo in your favorite Zwillingsherz outfit and post it as a feed post on Instagram.

2. Tag us in your post with @zwillingsherz_fashion or use the hashtag #zwillingsherz.

3. Follow our Instagram channel so we can contact you via private message if we would like to select your outfit.

Important: Tagging our account or using the hashtag does not yet grant us any usage rights. We will only use your content after we have explicitly requested it from you and you have agreed to our request.

 

Grant of Usage Rights

If we like your post, we will contact you via private Instagram message and explicitly ask if we may use your content.

Only if you explicitly agree to our request, you grant Zwillingsherz GmbH a simple, non-exclusive, spatially unlimited and temporally unlimited right of use for the content you have approved, free of charge.

The content may be used for Zwillingsherz's marketing and communication purposes, in particular on our social media channels such as Instagram, Facebook and Pinterest, in email marketing campaigns, and on our website www.zwillingsherz.com.

Use in paid advertising, such as Meta Ads, Pinterest Ads or Google Ads, will only occur if we explicitly state this in our request or if you separately agree to it.

We may adapt the content technically and creatively, in particular crop it, scale it, add layout elements or prepare it for various formats. Processing that distorts the meaning will not take place. 

No remuneration will be paid. You grant us the aforementioned rights of use free of charge.

You can revoke your consent at any time with effect for the future by email to info@zwillingsherz.com. The legality of the use made until revocation remains unaffected.

If you wish and it is technically possible, we will state your Instagram name or account. However, you agree that naming is not possible in every usage context, for example, with certain website displays, newsletter layouts, or social media formats.

 

Your Obligations 

You warrant that you have created the content you have released yourself or are authorized to grant us the usage rights described above.

You also confirm that your content does not infringe any third-party rights, in particular no copyrights, trademark rights, personal rights or other intellectual property rights.

If other persons are recognizable in your content, you confirm that these persons agree to the described use by Zwillingsherz. This applies in particular to publication and use on our social media channels, in email marketing campaigns and on our website.

You confirm that you are at least 18 years old. If minors are recognizable in the content, you confirm that the necessary consent of their legal representatives has been obtained. We reserve the right not to use content with recognizable minors or to request separate consent for this.

You also confirm that there are no fees, remuneration or other claims from third parties in connection with your content, or that these have been fully clarified and settled.

Should third parties assert claims against us due to the use of your content because you have violated the above assurances, you shall indemnify us from these claims. This includes reasonable costs of legal defense.

 

Our Obligations

If you wish at a later date that we no longer use your content, you can contact us at any time by email at info@zwillingsherz.com.

Upon receipt of your revocation, we will remove your content from our own channels within a reasonable period, as far as this is technically and actually possible for us.

Please note that content on the internet cannot always be completely deleted. This applies in particular if content has already been shared, saved, copied or redistributed by third parties. We have no influence on such uses by third parties.

We reserve the right to stop using your content at any time without prior notice and to remove the content from our channels.

We do not independently sell, lend or transfer your content to third parties. A transfer to technical service providers, agencies or platform providers may take place, insofar as this is necessary for the use described above.

 

Data Protection

In the context of using your content, personal data may be processed. This includes in particular your photo or video, your Instagram name, your profile name, your caption, and other publicly visible information associated with your post.

 Processing is carried out on the basis of your consent in accordance with Art. 6 (1) lit. a GDPR, insofar as you expressly agree to our request to use your content.

 You can revoke your consent at any time with effect for the future by email to info@zwillingsherz.com. The legality of processing up to the time of revocation remains unaffected.

 Under legal requirements, you have the right to information, rectification, erasure, restriction of processing, data portability, and objection. Further information on the processing of personal data can be found in our data protection declaration at:
